Who does ESOS apply to?

ESOS is mandatory for qualifying large undertakings and groups containing large undertakings.


Under Gibraltar's current ESOS framework, an organisation qualifies as a large undertaking if it meets either of the following conditions at 31st December 2026:

  • It employs 250 or more people; or

  • It has an annual turnover exceeding £44 million and an annual balance sheet total exceeding £38 million.


Corporate groups can also fall within the scheme, so determining whether your organisation qualifies may require consideration of the wider group structure rather than just one individual company.


If you are unsure whether your organisation falls within the scope of ESOS, it is worth establishing this early.


What does ESOS actually involve?

ESOS is designed to provide a comprehensive picture of how energy is consumed across a qualifying organisation.


This can include energy used in:

  • Buildings and facilities

  • Transport

  • Industrial and operational processes

  • Major energy-consuming equipment and activities


The aim is to understand the organisation's overall energy consumption and identify the areas that account for the majority of that consumption.


Under Gibraltar's current ESOS framework, organisations must identify and assess areas representing at least 95% of their total energy consumption.


That means ESOS is about more than looking at a single electricity bill or individual site.


It requires a broader view of how energy is being used across the relevant organisation.
